Legal Question in Landlord & Tenant Law in Michigan

We had a fire our rental home. My landlord has yet to send a list of damages for my security deposit since the fire on January 11, 2008. She did send a letter stating that they may sue me to damages to the house. We did not have rental insurance. The upper part of the house had no heat so we used electric blankets for the first winter since we lived there and my daughters caught on fire on her foot.

The landlord has not filed any papers with the courts about why she is keeping my deposit or any other matter. There is nothing in the lease about electric blankets. IT states no kerosene heaters.

We live on SSI and RSDI and have about 1400.00 a month income, so we cannot afford to hire a lawyer.

WE , my son and daughter, have had to replace all our bedroom things including clothes and things that were lost due to the fire.

What do I do???

The landlord should have had heat to the upper part of the house if it was intended to be occupied by tenants. That is her legal obligation. Since she breached the lease by not providing heat, you were forced to use the blankets.

You should send her a certified letter with a list of your damages and tell her that she needs to make a claim with her insurance company. If she will not do this then tell her you want the name of her insurance company.
