Legal Question in Landlord & Tenant Law in Michigan

My name is Keaira Durden i moved in to my apartment May 1 ,2009 and i signed a 12 month lease about 4 months into my lease i began to see mice so i went out and got traps . It seemed to help at first and then about a month or so i began to see mice all over the apartment on my bed in my cloths and in my food. I told my landlord and she hired and exterminator they came out to my apartment and put down trap and the very next day the traps were full so i went out again and got more traps and the mice still are coming i have 5 more months in my lease and i want to break it i just cant live like this anymore . if there is some way that i can break the lease with out it being elegal i wold like to know how.

have you put any of your complaints in writing? A mouse infestation is good cause to terminate a lease without facing legal recourse from a landlord. However, as with almost every defect or unsafe condition, you must give the landlord an opportunity to cure and fix the problem prior to just leaving or terminating your lease. It sounds like you have, however, I would need more details, such as the exact dates of your complaints, the amount of complaints, how many times they have tried to rectify the matter, and if they are willing to move you to another apartment free of charge, etc. Always always put any communications in writing and/or confirm verbal conversations with a letter after the fact to protect yourself. If there is a mouse problem and your landlord is not acting sufficiently, and does not offer you another apartment that perhaps does not have mice, you obviously can't live like that and need to move. To protect yourself, you should have a lawyer provide that notification to your landlord so you are not bothered with a frivolous lawsuit after the fact.
