Landlord says I am evicted

My landlord put a ''for rent'' sign outside my front yard. I called him and he said he was evicting for nonpayment of rent for four months, and that I owed him $2,000. He stated that he was on his way to the courthouse. I have lived here for three years, and I have counted all of my money order receipts and I have not missed a payment in three years. Also, I think I would know if I hadn't paid rent in four months. I have paid rent in full every month on time for three years. Can he do this to me? Thank you.

No. He must evict you legally. If you have paid rent, then you are entitled to at least 30 days notice. I suggest going to the district court in the county in which you reside and asking to see if there is a landlord/tenant case involving you and your landlord. Request a copy of any documentation for your review, record keeping, and assessment purposes.

He can certainly try, but if he does file eviction papers, you need to bring your documentation to court which proves that you are current on your rent, and always have been. By law, your landlord is required to serve you with eviction papers giving you 30 days notice to get out, BEFORE he files anything with the courts. If you haven't been served with anything yet, then he hasn't started the process.

Something doesn't quite add up here - if you were current on your rent, then why would be evicting you? Doesn't make sense.

Keep all paperwork you receive and if you have any discussions with him, confirm them IN WRITING.

If you are served with eviction papers, contact a lawyer immediately.
