Legal Question in Landlord & Tenant Law in Michigan
Can my landlord make me leave my stuff?
My partner and I opened a restaurant. He owns the building, I own the 50k loan and the stuff that was purchased with it. After it was clear the business wasn't making enough money- we signed rental agreements where I would pay him to rent. I want to move now, but he is saying he won't take over my 50k loan (secured by the property) unless I leave all the stuff I purchased with the business account. My business account. He said he will sue me and get it all anyway. Can he do this? Can I make him take over the loan for the equipment that the bank said I cannot remove from the building anyway? Don't I technically own all of the stuff even if it was purchased with the business account- since we changed contracts and he made me a renter with him having no part/ownership of my business? Are his threats real or is he trying to just get me to do it? He wants the cash register, lounge furniture, my personal computer, everything that this business HAS managed to buy over the last few years! Help, please, what do I do? I'm begging for help!

Re: Can my landlord make me leave my stuff?
Calm yourself. Logic / reason though you may not believe it sometimes, is the foundation of the law. I assume there was no partnership agreement. That being said, it is your word against his as to your agreement. What incentive does he have to take on the $50,000 loan?
You could settle the matter by leaving, taking the loan and the stuff that was purchased with it and he could pay you for the equipment he is keeping. He should be responsible to pay you for the equipment if he is keeping that.
However, I do not know what was your understanding at the commencement of the venture.
This sounds too complex for you to handle by yourself without legal representation.
