Legal Question in Landlord & Tenant Law in Michigan

landlord-still in house -construction

We signed our lease effective 8-1-08. The landlord originally told us the house renovations would be complete mid July, but they are still not finished and he is still in the house daily with contractors working. He allowed me to move my things in but I don't feel comfortable staying there or leaving my dogs there all day with contractors in and out. Should he have to credit us some rent until he is finished and out? We have already paid the full months rent and half the deposit (the other half is paid next month per mutual agreement).

Re: landlord-still in house -construction

That definitely sounds like a violation of your lease, even though the landlord probably couldn't control the construction delays. Check the terms of your lease agreement too.

Bottom line is that the house is not suitable for you to move in and reside, and therefore, you should not have to pay rent while you are not living there.

Please feel free to contact me if you need to retain a lawyer to assist you.

Put all communications IN WRITING to the landlord, in the event you have to take legal action to get your money back, etc.

Good luck.
