Legal Question in Landlord & Tenant Law in Michigan
landlrd tenant
Must I do a complete eviction thru the court and legal papers if someone has signed a written lease. the lease states that if rent is not paid on a certain day of each month that they have 7 days to vacate and landlord takes possession. It also states that if the utilities were shut off for any period of time that would cause eveiction too. The electricity was shut off from DTE it has been for about 2 weeks, and the tenants have just turned callled for gas to be turned off. They still do not have their stuff out and keep stating they have nowhere to put it. Can I go in and move this stuff out? what will happen. The contract her and I signed clearly states fact and it has been above and beyond the 7 days and electricity been off for 2 or more weeks. What can I do, if I get legal papers now it will only take longer and cause damage if any pipes break....

You still must use the legal system. Should you fail to do so, you could be liable for serious damages to the tenant.

Stuart is correct. You may only use the legal system. However, you may have a cause for a 3 days notice (instead of 7) due to potential damage to the property. This means 3 days after the notice you can file court action instead of 7.
