Legal Question in Landlord & Tenant Law in Michigan

Lease Termination Penality Fees

I have to break a 1 year lease and in the lease it states that I have to pay 2 months rent in order to get out. Now the property management is saying I need to pay a Consession Fee that consists of the difference between my current rent and the ''market value'' of the apartment for the remaining 7 months of the lease. However, nothing in my lease states anything about the ''market value'' of my apartment. The difference comes out to be an extra $1600 in fees. Do I have to pay these extras fees when the ''market value'' price is not stated in my lease?

Re: Lease Termination Penality Fees

You should contact an attorney to read the lease and figure out how you can get out of it. It may just take a letter from your attorney alerting the property manager what the lease says. It is the property manager who if you follow the 2 month rule would have to file suit against you.

The language of the lease regarding termination of tenancy controls and any ambiguities will be interpreted in your favor. You should have an attorney take a look at the lease and give you her advice. If you would like me to do this, please drop me an email with the lease scanned as a .pdf file.
