Legal Question in Landlord & Tenant Law in Michigan

I had been living in an apartment in Pontiac for about 2 years. Less than a month ago, some people came and vandalized some of the neighbors cars. They had asked the landlord to put a fence around the premises which he did not do. A week or so afterwards, I got robbed and assaulted badly by two strangers and had to go to the emergency room.

I was afraid of the area and that the robbers may come back so I decided the area was not safe and the landlord was not going to put a fence in in a timely fashion so I found another apartment and moved within ten days of telling him.

I was not technically on a lease, but AFTER I moved and he gave me a recommendation, he said I did not give him 30 days notice and he's not giving any of the security deposit back.

I would like to sue him for the deposit and in part for negligence and half of the emergency room fees and some punitive damages.

Thanks for your help.

I would need to see the terms of the lease you were operating under. However, it seems as though you did break the lease. Additionally, you would need to prove the landlord had a duty to put up a fence. It will be hard to show he is the direct cause of your damages.
