overdue maintenance

can I withhold my rent payment, if so how do I leagally go about it.

If your landlord is not living up to his/her obligations, such as not making repairs or keeping the premises in a habitable condition in violation of your lease terms, you can place your rent into an escrow account.

Make sure you put all requests for maintenance in writing with evidence that it was delivered to your landlord (such as certified mail).

You should also notify your landlord that you have placed the rent in an escrow account at X bank until such time as the repairs are made - that way he cannot not accuse you of not paying rent and/or start eviction proceedings.

Keep copies of all correspondence, bank records, etc.
