Legal Question in Landlord & Tenant Law in Michigan

Rent Paid in advance

I am getting evicted from my apt for 2 noise complaints. I paid the rent in advance for 6 months when I moved in. I have lived there for only 2 months now. So he essentially will owe me 3 months of rent. Is this like the sec. deposit and he has 30 days to pay it back or does he have to refund it when I move out?

Re: Rent Paid in advance

No. Take a good look at the terms of the contract to see if anything covers this situation. However, your landlord should be able to keep the three months if he is unable to find a tenant to take your place. Think of it this way. He was at risk of losing his other tenants if he did not evict you. Therefore, you have caused him to evict you and with you evicted, absent you having paid in advance, he would have had no tenant to fill your spot at that time.
