Legal Question in Landlord & Tenant Law in Michigan

Rental Trouble in Michigan

We are subletting. We also rent to this persons brother, who's great! I let their father talk me into renting to his other son even though I was reserved about it.

Since day one nothing but red flags. The brother not allowing them in his home when not there. Sneaking the sister in to live and not letting us know. Refusing to change over utilities and then telling me that a law recently passed making it illegal for me to shut the utilities off in my name because of thier baby. Removing a hood vent and telling us afterward. Neighbors mad about middle of the night arguments. The worst is feeling sorry for them and giving them a bunch of furniture. I fell for the sob stories!!

These people have been here ONE week tomorrow!!! At this time a lease has not been signed and they have not asked for receipts. We just want them gone! I'm assuming they're not legally tenants? What is the proper avenue to get them out? I was planning on giving them a month to vacate and thier security deposit back. I'm sure if I involve the parents there won't be a problem. From advice, I am going to take pics of the inside and out before I give notice. Should I involve the police so I have a witness of the current condition?

Re: Rental Trouble in Michigan

They are absolutely tenants. You would need to give them a Notice to Quit, then file suit for eviction in District Court, citing all the reasons they have violated your oral lease with them. You might have a problem because you cannot collect a security deposit without a proper lease and the requisite notices. Visit www.kliszlaw.com for more information and how to contact my office.
