Legal Question in Legal Ethics in Michigan

Expunged records

If a misdemeanor, which occured at age 17,has been expunged from records, can one ethically and legally state on a job application that you have not been convicted of that misdemeanor? This is in reference to a 30 yr. old who had a misdemeanor for drug paraphernalia (no drug involved)in a car when stopped for a traffic violation.

As far as I know, if it is expunged, it never existed. However, I know that some employers and applicants for professional licenses are asked if they have ever been arrested. The answer to that is yes. Bill Stern
