Legal Question in Legal Ethics in Michigan

fell from ladder at work

i was working on a ladder, a unknown customer pushed something into the ladder and i feel 6-8 feet and the main bones in my foot. the costumer booked it out and we have no idea who it was. i was told by someone yesturday that there is a OSHA/MIOSHA law stating that you have to have someone at the bottom of the ladder or around for safety issues or you can sue. i was never informed of this and ended up getting hurt. the manager knew i was going on the ladder because i was told to put some hats up. they paid workmans comp and all and i already went back to work, all i can do is sit and ticket items. i still have a cast on. is there anything worth suing over or has my friend lost her mind?

Your friend doesn't know what he or she is talking about. You cannot sue your employer for anything except workers comp which they paid anyway. The only exception is when your employer intentionally injures you and intends to cause the injury, which is not your situation. You can sue a 3rd party other than your employer if they are negligent and the negligence causes your damage. The 3rd party here is the customer and he left so there is not case. William S. Stern
