Quick question regarding a filing proceedure

Hi,

I am a defendant in a small civil case. I have been served, and the plaintiff misspelled my name when they filed. More specifically, the middle initial is incorrect.

If I show this in my answer, and perhaps even provide documentation to prove it, would this be grounds for requiring the plaintiff to re-file and have me served all over again.

I know this sounds pointless, but not to me. I am leaving town very soon, and I may be able to avoid the second service.

They will just amend the complaint to reflect the proper name. Don't waste your time. Address the case head on.
