Legal Question in Medical Malpractice in Michigan
I had a archellis tendon rupture repair in March of 09. Its Jan of 10 and the bottom of my foot is still numb. I had this surgery on my other foot 10 yrs ago with no numbness of my foot lingering. This numbness causes me unbalance problems! I work with power tools, heavy machinery, and drive vehicles for my Employer.I'm concerned if my employer finds out about my unbalance problem from not being able to feel my foot correctly, they may take me out of that department and put me in a lesser paying job, with less responsibilities! I talked to a ortho-pedic surgen other than the one that did my surgery and he said that the surgen most likely cut a main nerve that goes along that tendon that they repaired. He said he see it alot! What should I do to protect myself and my job!

In all honsty, I do not know if severing that tendon would violate the standard of care that the doctor owed to the patient. The case would have to b reviewed by a respected orthopedic surgeon to get a proper opinion. Evaluations of this nature are performed by doctors from other states as it is very difficult to get a disinterested opinion from someone from the area.
