Legal Question in Medical Malpractice in Michigan
bile duct injury
daughter had what was supposed to have laproscopic gallbladder surgery, but turned out to be a open surgery because the common bile duct got nicked twice during surgery. dr put in a drain and set her home in a couple of days, she returned to the ER a few days later because pain was uncontrollable at home. dr couldn't get the leak stopped. her drain tube stopped draining, all the bile was going into the abdomen. dr then said there was nothing more he could do and suggested another facility. I suggested another well known medical facility in another state and he approved. this was 2 weeks after the initial surgery. got to the other facility they immediately went and stented the leaks. she was put on alert to go to ICU because her vitals were troublesome. she spent 2 weeks in the hospital there, came home, then had to go back for a week and will continue to go back for an undisclosed period of time. Is there a case against the first physician and hospital? The parents are paying all the bills that the insurance has not paid and of course the travel expenses also and sacificing time off work to do travel out of state for her treatment.
