Legal Question in Medical Malpractice in Michigan

Daughter born 3 months early due to doctor neglagence

When my wife was pregnant with our daughter she had abdominal pains all throughout my pregnancy. The doctors told us that it was just the ligiments around her uterus stretching. Our daugther ended up being born at 26 weeks (3 months early). She was in the hospital 2 1/2 months. Now is on disability with breathing problems, possible hearing loss and vision problems. Do you think that my wife and I have a case? And if so what are the chances.

I am very sorry to hear about what occured to your wife and daughter and I hope that your daughter makes a full recovery.

You may have a case but in order to better make a determination, we would need more facts. In other words, you "may" have a case.

Medical malpractice cases are really a war of experts and it comes down to the question of what is the proper standard of care. If the standard of prenatal care your wife received is below what is considered standard and several experts will testify to that effect, then you have a case. If the standard of care she received is within the norm and what occurred to her could not have been prevented then it is less likely that this is a case.

Also, we would need to know the number of times your wife visited the doctors office and complained of the pain. How many ultra sounds were done? Was there any attempt on the part of the doctors office to look into the pains or was it (at all times) dismissed as routine stretching?
