Legal Question in Medical Malpractice in Michigan
My father passed away Jan 7th of 2009..He was given Morphine and died 2 days later, He was not in any pain ...Hospice authorized this medication without a Dr seeing my dad...I believe this is illegal....My dad would be alive today if not given Morphine...He was 80 years old and Morphine shuts down the body in Elderly patients...Therefore he never should have been given morphine....Do I have a legal case to Sue Hospice and the Nursing Home for dispensing a Controled Suptance without a Doctor reviewing and seeing my father first...I live in Michigan Wrongful Death or Medical Malpractice ?

First, my sympathies on the loss of your father. Second, your inquiry does not provide the condition that your father was suffering from. Was he dying? Most patients who land in "hospice" are terminal and sent there to die in comfort. That is what Morphine is used for in that setting, to provide the patient a peaceful death. I would need to see all of your dad''s records and have them reviewed by an appropriate expert to deternime whether this was medical malpractice. Michigan is a heavily tort reformed state and it is difficult to pursue this type of case in our current litigation climate. When you hear people talk about "lawsuit abuse" and "tort reform" they are usually trying to trample on your civil rights. It is time that we all stand up for victims in this country.
