Hemostat left behind at end of surgery

Sirs,

I had my prostate removed twelve years ago. Because I have had recent agravation, I had an examination that found a hemostat was left in the bladder. Now I must have another surgery,at my own expense, to remove it. Who is responsible for leaving this behind? Is it the surgeon, or the hospital staff?

You need to see a laweyr immeidately. There are two issues you must deal with immediately. First, there is what is called a statute of repose. this is a statute that does not allow a malpractice claim after X number of years, regardless of when you discover it. The second problem is the statute of limitations is 6 months from the date that you discover the error. You have no time to waste as that statute runs very, very quickly.
