Even assuming there was malpractice (which is definitely not a certainty), there is not enough damage on which to base a malpractice case. Malpractice cases are extremely expensive to pursue so the damages must be very great in order to merit the financial investment. A jury would not return with a large enough verdict to merit the potential investment. A lawyer who knows what he or she is doing does not pursue a medical malpractice case in order to extract a settlement. When you start a malpractice case, be ready to take it all the way through trial and beyond (appeals). This involves the potential of years of work and litigation.
You certainly have rights in this matter and I think you need to call me immediately so we can further discuss the possibilities. I offer 24/7 availability at 810-227-7200.
