Legal Question in Medical Malpractice in Michigan
medical malpractice
I am 1 of about 10,000 patients who underwent surgical procedures by a dr that used the same needles & scalpels on multiple patients. I have rec'd ltr from Health Dept advising to get tested for HIV/HEPB-C. If I am not infected, do I still have a medical malpractice case?

Yes, I would think that you have a case on the argument that your damage includes having to undergo testing and the emotional distress and worry of the possibility of having been infected.
If you would like the name of an excellent MI med mal attorney, please let me know. I used to defend hospitals and physicians in med mal cases and have a good grasp of Michigan med mal plaintiff attorneys, and which ones were formidable opponents. I do have a favorite.

First of all, be thankful if the tests are negative.
If this is an Illinois case you must prove that there was actual exposure to HIV/Hep for a malpractice case.
