Legal Question in Medical Malpractice in Michigan

Medical Malpractise

I had--name removed--trip and fall accident on 9-29-08 I have been to the doctors complaining of pain from my neck to my hips and even my legs. The doctor that examined me said I might have--name removed--rotar cuff injury but is still sending me back to work with no restrictions. She also perscribed--name removed--narcotic for me but told me I was not allowed to drive while taking, but yet she still put me back to work. I am to return to work on Tuesday am in pain all down my left side, can barely lift my left arm without pain and have no restrictions pertaining to my duties at work. What I am concerned about is I am being sent back to work with an injury as I am the one that knows my own body. I have no restrictions and she does not have any results as I don't even go for an ultra sound until Wednesday. If there is an injury and I damage it more is this doctor Liable?

Re: Medical Malpractise

The doctor may be responsible but you also have responsibility because you know there is something wrong yet you are going back to work. Do not go back to work. Revisit the issue with your doctor telling them that you are uncomfortable with their advice and believe that it is would be best to wait until the results to return to work considering the symptoms you are having. If you could have an injury per the doctor's information, then it would be negligent for them to send you back to work without restrictions until they have ruled out the fact that you have an injury.
