Medical Malpractrice
My husband was diagnose with cancer in 2006 and have been going to the same Dr. since 2001 before we even met. He started complaning of shoulder pain in 2004 the same year we married. He went back and forth to the Dr. about his shoulder, was taken off work a couple of times but his Dr. never gave him an Xray or anything. My husband died in 2008. Before he died I ask him to get his medical reports and some of his reports were missing. Of course I am angry. Is there fgrounds for malpractice ?

It is impossible to give you a definitive answer with the sparse information that you have. You must see a lawyer who does this kind of work. That lawyer will have to start an estate to allow you to obtain the medical records. Then, once the records are obtained, you can see the type of complaints your husband made and the findings of the doctors. If it looks like the doctor ignored something that a doctor with similar credentials would not have ignored, then the case will be referred to a doctor with the same credentials as your husband's doctor for an opinion as to whether or not the doctor committed malpractice. At that point, if the opinion is positive, a proper notice will be sent out to the doctor involved. Once 154 to 182 days passes, suit will be started. This is a very specialized area of law and you should see a lawyer familiar with this area of the law. You must keep in mind that you have a very limited amount of time to act...usually 2 years from the date of malpractice. Therefore, you should take action quickly. Feel free to call. William S.
