She can file suit against his estate and his malpractice insurance carrier will step up.

She can still pursue a case. However, an estate will have to be started and th lawsuit will have to proceed against the personal representative of the doctor's estate. Malpractice cases are among the most complex in the legal system. She should not be doing anything on this herself. She should contact a lawyer specializing in this area of the law.
