Neuroma surgery

I had neuroma surgery on 3/29/02.I am still off work with pain around the area operated on. My podiatrist did not follow the standard procedure that comes before you have surgery. He had told me after one shot,that there was nothing else he could do except operate.He now is giving me cortizone shots,after I had surgery;and it's not helping.I finally got him to say that he thinks it is a nerve in my foot that is giving me trouble,after 5 months. I am asking to be referred to neurologist. If the neurologist determines that it is nerve damage,can I then go back and sue my podiatrist for not following procedures before doing the surgery? And if it turns out that I have RSD,can I sue for not making the diagnosis within the 3 months that it should of been made by?
