If the vet committed malpractice, it is highly doubtful that you will be able to pursue a case. In order to pursue a case for veterinary malpractice, you would have to have another vet testify that the first vet did something that a reasonable vet in similar circumstances would not have done. The second vet would have to testify against the first vet, not by a letter, but actual testimony. This would cost a great deal of money. Furthermore, in Michigan, you cannot recover for the non-economic losses, such as the emotional distress that this put you through. You are limited to out of pocket expenses and there is some case law indicating that your damages are capped at the market value of the pet. Therefore, the practical effect of this is that it is virtually impossible to sue a vet for much of anything, unless they are working on a valuable animal.
