Legal Question in Medical Malpractice in Michigan

Plastic Surgery Malpractice

On March 11, 2004 had a mini/1 hour facelift and upper and lower eye job. The result was ''pixie/devil ears'' severe scarring around the ears, ears were pulled down too far and both eyes had too much skin removed causing ''ectropian''. Further surgery will probably be needed to correct the lower lid condition which is highly visible especially in my wedding pictures from 7/3/2004. I have to see an opthamologic surgeon on 8/30/2004. On May 13 went to Straith Clinic for a second opinion on both procedures performed by original surgeon and was told it was the ''worst'' job he had ever seen and said I needed a full facelift to correct the ''pixie ears'' and scarring. On May 28th I had 5 1/2 hours of corrective surgery to fix the ears, he revised scars on the right eye but can not do anything about the ectropian because he's not an opthamologist. The second Surgery cost $7,050. I have all the before and after pictures plus records galore and professional opinions. I am in debt big time because all of this was out of pocket plus the time off of work for both procedures and possibly the 3rd. Is this Malpractice? The original Surgeon has done nothing to compensate me, claimed it would rectify itself. Thanks

Re: Plastic Surgery Malpractice

These types of cases are very difficult because while the Straith doctor talks a good game when speaking with the patient, I can guarantee you that he would refuse to testify against another physician in court. Furthermore, some of this is a matter of "taste"...beauty to one of not beauty to another. However, I cannot evaluate your situation without looking at your records and seeing you myself. Feel free to contact me at 248-353-9400 to set this up. If there is a possibility that I may be of assistance to you, I may have an associate review your situation, also. William S. Stern
