Legal Question in Military Law in Michigan

General Discharge

I just found out that I was given a General Discharge with a re3 reenlistment code On my nbg form 22 stating for the authority and reason Para 8-26e(ngr 600-200, acts or patterns of misconduct- abuse of illegal drugs). is there anyway to contest this? I have no history nor pattern of use. I dont recall doing the act but they said I failed my urinalisis in year 2000. I am not going to contest this nor can I admit it because it is not in my character. Everyone in my unit including myself were regularly tested each month (MP Unit). Up to then I have had a excellent service record with prior honorable discharges from 2 seperate enlistments. I dont know what to do. I feel I have wasted 10 years of great service. I know I can get back in with a waiver but I am now married and reenlisting is slim to no possibility. What are my options if any? Is my character now perminate as a drug using junkie? I feel miserable over all this someone please help........

John K. Harris Attorney at Law

Re: General Discharge

Your future attorney can submit a legal brief to the Army Discharge Review Board (DRB) arguing why your discharge is inequitable or improper. If the DRB upgrades your discharge, the board will also consider whether your RE code should be changed to a "3A"--a waiveable code. Your attorney, however, will need to submit a legal brief directly to the Army Board of Correction of Military Records if you only want to have you RE code changed.
