Car Accident - Injury
I was involved in an auto accident 1 year ago, with the other driver at fault. I received injuries to both knees. I was unable to walk for 1 week, then used crutches for 1 week, received physical therapy twice and continueing to have problems. Do I have a case? I was told I will have problems for the rest of my life. What can I do at this point?

In Michigan, a person injured by a third party in an auto accident can recover from that third party (or his insurance company) if the third party was negligent and if that person suffers a permanent impairment of a bodily function or a permanent serious disfigurment (or death). I would need to speak to you to determine if you have a cause of action against the other driver, or if there may be other ways to collect for your injuries. Please call to discuss.

Much may be done, but I would need more facts to be sure. Were you insured at the time? Were you a driver, or a passenger? What kind of problems are you still having? Has your doctor recommended future medical treatment?

This is in response to your email of February 15, 2001, which we received on March 30, 2001.
In Michigan, you have three years from the date of the automobile accident to file a claim against the person who hit you.
In order to be successful with your claim, the other party must be at least 51% at fault and your injuries must have �caused you a significant impairment of a bodily function�.
