Legal Question in Personal Injury in Michigan

Celebrity copycats

Can a celebrity bring a successful suit against another celebrity who poorly emulates her sing style, voice, costumes, etc. The celebrity feels that it damages her acting opportunities. What kind of suit is it? Personal injury, defamation of character?

Right of Publicity. In general, an individual has the right to control and profit from commercial use of his/her name, likeness, persona. An individual has the right to protect his public persona from loss of commercial value resulting from misappropriation of the individual's identity for commercial purposes.

Right of Publicity, misappropriation of commercial persona, and related law are largely controlled by the laws of each individual state.

Hope that helps.

Sarah

P.S. This is an Intellectual Property question (not personal injury).
