Legal Question in Personal Injury in Michigan

Commercial property injury case

My husband had a slip and fall injury at a commercial business back 2002, which resulted in a herniated disc in his neck. Afer 4 yrs of fighting it with therapy and injections surgery was a must. We were told by our attorney that these type of cases are only worth $45K tops. This was what the attorney for the business was telling our laywer, if we decided to proceed any further and lost we could be liable for all of the cost associated for both sides. Since we are collectable, the thought of losing more money than he stood to gain was sickining. Is there any way we can access all of the public records on this case? Is there any way to check if the attorney's exchanged funds? Does $45K sound normal for a case like this? Thank you for your advice.

Your suspicions show only that you do not understand what has happened in the legal system. If you live in Michigan, the entire system has been corrupted by Supreme Court justices who have made decisions favoring the insurance industry. If there is any chance that you should have been aware of the defect or seen the defect that caused the fall, you lose. It sounds like your case went through case evaluation and you were worried about economic sanctions if you lost. You had good reason. Your attorney was giving you advice based on the fact that 90 +% of these cases are either dismissed by the courts based upon law handed down by the Michigan Supreme Court or juries find in favor of the defendant. You should not be suspecting your lawyer of any misconduct. You should be enraged at the fact that the court system has been hijacked by the insurance industry. You cannot believe that it has happened and that is why you suspect your lawyer. Your lawyer is simply trying to do his or her best in the adverse conditions in which we operate today. William S.
