Legal Question in Personal Injury in Michigan

My daughter was in an auto accident - she did not receive a ticket. The person who did receive the ticket was pushing a vehicle down a busy street and thru a red light. He hit my daughter's car and totaled it. His insurance company is not paying us any money because of a mini Tort law in his auto insurance. His insurance company said we would have to take him to court. Is this person protected by a $500 limit or could we get more?
