Re: Decisions for Incapacitated Adult

When you say "incapacitated" I assume you mean that the injured person cannot communicate at all to third parties. If this is the case, a person concerned for the injured person's welfare can petition the court to be named as the person responsible for said purposes, whether it be medical decisions, insurance claim or legal action. This is usually done contemporanously with the filing of a lawsuit, if there is one, but can be heard before filing or in a seperate action. Any attorney handling such a case would take care of this.

You should consult an attorney in your area to determine the best course of action in your circumstances and venue.

Good luck to you.
