Defamation against Michigan Company by California Resident
I have a customer who is making false accusations against my company by e-mail and distributing them. In the e-mail, he says that he will continue to send this spam until the people he is sending it to forward the letter to as many people as they can. Here is a quote from the letter: ''The way to make me stop is send it to so many people as fast as you can and lets put her out of business.''
For the background info, he is unhappy because he bought products from me about 1 week ago, and they have not yet arrived. The terms of sale (http://www.wholesalestop.com/terms.html'') state that some items will have a delivery time of 2-3 weeks. He has told me he will refuse delivery on these items when they arrive and the shipping will be billed back to me for the return.
I am wondering if I have grounds to sue on, and if the jurisdiction is in California (where he resides) or in MI (where I reside). The sale amount was $186.00.

Hello, I have received a copy of your e-mail regarding slander/libel against you or your company. Yes, you probably have a case. However, I am not sure it is worthwhile pursuing in light of the amount involved unless you can show there has been an actual damage to your reputation or business. I would have to know the actual words being used. Finally, I cannot answer the issue of where you can sue off the top of my head. Is the defendant doing business in Michigan? Are the e-mails being sent to residents of Michigan? What connection does the defendant have with Michigan? Maybe it would just be a whole lot simpler to return the money and say good riddance.
