Legal Question in Personal Injury in Michigan

Hospitals

My friend was injured and taken to a hospital. He is treated for 2 days then released. It is the hospital policy that all patients must ride in a wheelchair until they are outside of the hospital doors. The attendants pushing the cart dump the wheelchair and he falls and brakes both ankles. The state case law is that hospitals are immune from litigation because they are charitable institutions. (So I hear). My friends wants to sue. Can he? Why or why not?

It is true that hospitals are immune in some states. I do not know about Michigan. Other states put caps on the damages that you can recover from the hospital. In those states many attorneys bring the cases against the individuals or know some other way to help the victim recover. He should consult an attorney with some experience with hospitals in Michigan.
