Obtaining No-Fault Auto Benefits
Was involved in MVA in 9-2002. This is a no-fault state. Other driver admits liability. I filed a claim with my ins. co. for wage loss, medical expenses, etc. After filing the claim and submitting all docs as requested I received no other response or payment from them. I had to hire an attorney to obtain benefits. Paid on hit and miss basis, every 4-5 months or so. Filed 1st party claim against my auto ins. co., asking for reimbursement of attorney fees since they forced me to seek legal assist. They refuse to reimburse me for this cost and my attorney states that it will be impossible to get them to reimburse my legal fees. The auto ins. co. would not respond to my claim submissions nor return phone calls, forcing me to hire legal assistance. Is it true that they don't have to reimburse me legal fees? Is there some type of other suit I can file to be reimbursed these fees? My attorney does not want to go after these monies for me, told me to forget about it, but I am already out $9,000, his 1/3 of my no fault benefits. I am near bankruptcy, lost my job, etc. Please advise.

Your attorney is most likely correct. Welcome to Michigan. You elected the jerks in the courts and the a-holes in the legislature who took away your rights. You heard about it during the elections but only assumed that it was election hyperbole. Now you understand that your rights have been taken away and the electorate has no one to blame but themselves. Bill Stern
