Legal Question in Personal Injury in Michigan
Personal Injury
My boyfriend was in an accident in Arkansas 8/26/07. The driver of the car came from behind and hit him. he was on a motorcycle. He has sustained substantial injuries for which he is still being treated. He was life flighted to Little Rock and treated there as it was the only Trauma center in Arkansas. We heard that the lady driving the car may have been deceased prior to hitting him. Also, the police report stated that she had some sort of ''prohibited/restricted license''. Her insurance said that she only had 20/k coverage on bodily injury. His medical bills will possibly be 5 times that. He suffered a 9.5 de-glovement of the head out of a possible 10 severity. He is currently receiving skin graphs to cover the skull and knee. He is also being treated as a burn patient from where he hit the road. What re-course does he have? We need to know that his medical bills will be covered and also what about long term effects from the massive head injury. We also need to know where he should get an attorney. Arkansas? Texas? He was living in Texas and the other motorist was from Texas although the accident happened in Arkansas. What about his pain and suffering? Any help would be appreciated.

An accident that occurred in Arkansas will be controlled by Arkansas law. Consult with a firm in Arkansas that specializes in personal injury auto accidents in Arkansas.
Re: Personal Injury
Since both parties are in Texas, I would consult a Texas lawyer as soon as possible.
If you have any further questions of a general nature, I would be glad to help if you will contact me at www.lawrefs.com. However, I am a Michigan attorney, so can only advise on Michigan law.
God bless you both and good luck. My prayers are with you.
Re: Personal Injury
Almost undoubtedly, the suit will have to be brought where the collision occurred. These are tricky cases because the medical records of the other driver have a confidentiality that must be pierced. However, if she only had minimal coverage for liability, it may not be worth the fight to the insurance company and they may settle. You may be able to do that with a local attorney. As far as the medical payment issue, every state is different and either myself or another local attorney could find that out. My guess is that the benefits will not be nearly as good as we are used ot in Michigan regarding the medical. Feel free to give me a call. William S. Stern, Southfield, Michigan.
