I work for a company for 13 years . they have been in violation for emmisions since they opened in 1988 i now have severe lung problems i havn't worked since feb.2001 due to my lungs and can't go back. i have a lawyer it goes to court this month my lawyer may be asked to settle out of court.i havnt recived any workers compm or medical leave 26 weeks paid.my lawyer said we�would settel out of court unless they offer us something crummy. i asked what would be unaccepebil ? he wrote backsome ware around a nuscence of 2,500.00 dose that sound right? is that a joke remember i can't ever work again. did he think that it was a stupid question and didn't want me to bother him with such a question ? we have also supponed the DEQ for tril. what should i expect? please e-mail me back with some type of help i need to have my mind at ease ,thank you--name removed--

Hello, I have received a copy of your e-mail regarding your lung condition and your law suit. I cannot give you a definite answer because I don't know all of the facts that would support liability on the part of the defendant(s). I can tell you that I would seek a second opinion right away. You are correct that $2,500.00 seems low in light of your physical condition. My office does not handle lung cases but I have worked with attorneys who do. I saw the reply of the other lawyer. I can be of more help. First, did you take a regular retirement? That is important because if you did, for each dollar you get from your pension, you would have a dollar deducted from your workers compensation. Second, if you took a regular retirement, there is actually a presumption against you. Also, I have to know if you were performing the regular duties of your employment as of the last day of work.
