Legal Question in Personal Injury in Michigan
Sidewalk accident
I was rollerblading on the sidewalk and there was a patch of cement that was torn up and covered with tar. I slowed down but still fell and sprained my ankle. I could not walk for 2 days but, I did not go to the doctors because I knew it was not broken. I could not sleep so I took a prescription pain pill that was in my sisters name. Then 2 days later I had to take a drug test for a job I was just hired for. I did not know that it was aginst the law or that it would even still be in my system 2 days later. The doctor found traces of the pain pill and had to fail me on the test because the prescription was not in my name. Therefore, I could not be hired for the job which would have greatly helped me get into the field of photography which I am going to college for.
I have a witness my sister had to come pick me up because I could not walk.
My question is can I do anything about this?

Re: Sidewalk accident
There are many reasons why there is no case. It may very well not be negligence on the part of the homeowner or city to repair the walkay in that manner. Your comparitive negligence in skating too fast to stop or slow down will lessen or eliminate a recovery. Also, it may very well not be forseeable that you lost a job opportunity as a result of taking the illegal pills. Also, your damages are too speculative. There is simply no case. Bill Stern
