Legal Question in Personal Injury in Michigan

My student son was attacked

My 16 year-old son was attacked from behind at school on their premises and suffered a broken foot as a result. The security dept. and local police dept. seem to be dragging their feet as far as arresting the attacker. We also believe this to be racially motivated, since the attacker and his friends were hispanic and my son was called ''white boy''. My son did not provoke the other student and after a brief argument was attacked from behind as he ''walked away from trouble'', which is what I taught him to do. I am beginning to think the attacker will get away with this and we'll be left with my son's broken foot and loss-time from his steady part-time job. The officer in charge of the investigation is STILL not done making out his report 6 days after the incident and I am beginning to wonder if I should get an attorney to handle this nonsense for me? Do we have a good solid case here? Thanks.

The worst thing you could do would be to get an attorney to sue the boy. The private attorney has no standing to make the police or prosecutor do anything. If the cop does nothing, go directly to the prosecutor yourself to get criminal charges filed. All you would do by suing the boy at this point is to open you son up to more problems at school.
