Legal Question in Personal Injury in Michigan

Wage Loss Reimbursement

Was injured in MVA 2002 and have lost the job I was working at the time. Am finally collecting 1st party benefits. My current job pays $2 less per hour than the one I was working at time of MVA. Does the auto insurance co. have to make up the wage difference under MI law? I have sent them proof of wage difference and a letter from my previous employer stating that I lost my position due to being unable to work full-time. Also, I have had 2 surgeries and for a short period of time have been unable to work due to post-op recovery. Are these wages also reimburseable under MI law?

Re: Wage Loss Reimbursement

Yes. The no-fault carrier has to make up the difference, unless you are already maxed out under the law dictating the maximum amount recoverable. Bill Stern
