Weight falls on foot
In Target, I picked up a 20lb. barbell and the end was not screwed on. The solid metal approx. 10lb. piece fell on by foot, causing my large toe to immediatly bruise and terrible pain. The manager came and tried to lighten the mood with a joke. I went to the hospital for x-rays, but the toe was not broken, just very bruised and they had to make a hole in the nail to release some of the blood. I am a server and was not able to work that night, and was put at a disadvantage when I went back to work. For almost 10 days my toe caused me a lot of pain. Target first offered me a $50 gift card and to pay my hospital bill, when I said that work was missed, she said she would have to have an investigation. The next morning she called and offered me $300, I told her I would think about that. The next day it was $400. Is this a fair settlement, and how much do you think they are willing to pay? I want to settle, but also don't want to let them get off too easy, It was the stores fault for not checking their merchendise.

If your toe still hurts, it might be worth a LOT more than $400. If you have trouble walking, sleeping, doing the things you ordinarily do - sports etc - then its worth more. Depending on how much pain you have had or have now, it might be useful to have an attorney do the negotiating.
