Legal Question in Real Estate Law in Michigan
We are on our second attempt to refinance our home with our mortgage company after starting the process in August of 2010. The first loan application was canceled when they said we had exceeded our time limit. We had received very limited communication from our loan officer and were not aware there was a time limit. In addition, we had provided all requested information promptly. The bank requested additional information within weeks of the deadline (again without informing us there was one); however, we were unsure as to the specific documents they were requesting. We repeatedly emailed and called our loan officer and did not hear back from her for 2 weeks. Our next communication from her was to say our loan was dropped because we had passed the time limit.
We contacted the company and filed a complaint. The response was to open a new loan with a different loan officer; however, they required us to pay for another home appraisal, with the same appraisal company and appraiser, even though we were not at fault for the original loan being dropped.
Our question is can we press being reimbursed for the cost of the reappraisal? Also, we have met with many of the same issues with our current refinancing and are quickly approaching the deadline. We have provided them with everything they have asked for within 24 hours of receiving the requests and have also put additional money into reflooring a room in our house based on their request. Now we have heard from the appraiser that there were supposed to be additional repairs that were never reported to us by our loan officer. Is there anything we can do to make sure that this loan is not also dropped?
