Legal Question in Real Estate Law in Michigan
We bought a puppy that we have decided is not going to work out for us. We do not expect a refund but we would like to recoup some of the $1000 that we spent. We are looking into selling her to a good home but are wondering what our rights are. Do we simply have to get an offer from someone and if the breeder does not want to buy her back then we are free to sell her? Does the contract that we signed follow the dog so the new family will have to abide by the terms? Does the breeder have the right to demand the puppy back at no cost?
Wording from the contract:
"Should the dog ever be offered for sale, given away, or otherwise disposed of, the seller has the first rights of refusal."
"The terms of this contract are binding upon any subsequent owners"

I would argue that the contract is binding and you have to offer it back to the breeder first. If they don't want to buy it back, you can then sell it to others. Depending on the other terms of the contract, of course, which I have not reviewed. Good luck. www.kliszlaw.com Tim Klisz
