Legal Question in Real Estate Law in Michigan

Condo Association Fee Dispute

My condo association claims I owe late fees from 2005 and they are now threatening a lien to my condo. I disagree with the validity of the late fees. I believe the management company, not the condo association, is trying to charge these fees without notifying me that the fees would be applied in the first place. When I disputed the fees in 2006, they ignored my correspondence. The management company is reallocating my current payments for monthly association fees to the ''late fees'' and then saying I did not make my monthly payment in full--therefore I owe more late fees! Is this legal?

Re: Condo Association Fee Dispute

Without a written agreement that this will take place, no. Check your Bylaws. You may have to proceed in court. I would suggest this because you will get nowhere unless you are "in" with the Board.
