Legal Question in Real Estate Law in Michigan

Was contacted by mortgage company that i was behind I made all the payment and they said i was current. and continued to make regular payments for 2 more months. I did not receive statement for july and called to let them know and make the payment. They told me they sold my house the day before and my account was closed. Can they take my house from me. They kept taking my payments up until they sold my house. PLEASE HELP ME!

If you can prove that your loan was current when the mortgage company "sold" the house, then you may challenge the sale as invalid. Do you have your cancelled checks? If you were behind on your loan, it's possible that the lender simply started foreclosure proceedings against you. You would have been notified, by mail and by a posting on the property. Did you recieve "notice of foreclosure"? If the lender has actually foreclosed, you still have the right of redemption. The amount of time you have to redeem is more than 30 days, and could be up to 1 year, this depends on how much equity you have in the property, UNLESS the property has been abandoned. Do you live there?

Do not hesitate to consult a real estate attorney or you may run out of time to dispute the lender's actions. You need to provide more information so that an attorney can apply the law to the facts of your case.
