Legal Question in Real Estate Law in Michigan

Contractor Liens

I built home in MI with a Builder. They have now gone out of Business(Bank took over assets) and some of the Subcontractors that worked on my Home, have not been paid. I paid the builder in full. The contract for the Subs was with the builder not I the owner.

The subs are threatening to put

liens on my home.

Do they have a valid lien potential, even though I did not have a contract with them?

Re: Contractor Liens

There is a fund in Michigan for this particular situation - The Michigan Homeowner Construction Lien Recovery Fund. Please go to the following website to find out more about your rights and responsibilities: http://www.cis.state.mi.us/bcsc/forms/conlien/llf-600.pdf

Re: Contractor Liens

Your question applies to MI law and I am not licensed to practice in MI and am unfamiliar with lien law in MI. However, in WI, the subs would have a 6 month period from completing the work to file liens and would have that right during that time period. That's why when you buy new construction you need to get lien waivers from all subs and suppliers along with the lien waiver from the general contractor. Assuming MI has a similar setup, if the liens are filed timely the subs have a right to file the liens. You should contact a MI licensed attorney asap to protect your property.
