Getting deposit back from a builder

My son put a $10,000 deposit with a builder. He is unable to sell his condo. He can not afford to keep the condo and build the home. The builder has not started to build the home. The agreement states that he will lose the deposit if he doesn't pay the next installment of $5000 by a certain date. Can he legally get his deposit back and back out of this agreement?

It depends on the terms of the contract, and whether the builder has done anything to breach the contract. I deal with these issues all the time with builders in Michigan and out of state. If you'd like me to look at the contract and give you an opinion, please contact me.
