Legal Question in Real Estate Law in Michigan

Home Association HOA

I purchased a foreclosed home in Michigan. I was not aware of the Home Owners Association and nothing was presented at closing and there is no mention of the HOA in the Property Deed. Can I be forced to join this HOA. These are public streets!

The deed itself quite frequently does not address an HOA specifically. However, most frequently there has been some documentation, such as bylaws/covenants/restriction recorded when the original community was planned and developed. It maybe within the Master Deed or set as a differently recorded item. If there is such a recording you are deemed to have known of it when you purchased. In addition, it is not uncommon for an HOA to exist in a community that has dedicated the streets to a public municipality. Quite frequently the HOA is still responsible for mailboxes, sidewalks, signs, park equipment and maintenance and any restrictions on the aesthetics of the community, but each community differs.
