Home purchase & non disclosure of info

Purchased a home in 1999 but was not notified of a sewer project that was in the works. We are now required to connect to this sewer & want to know what our options are?

I take it the sewer project is something being put in by the city or county? Are you being asked to pay a fee to hookup to the sewer? Whether you have any legal recourse against the previous owner/seller depends on the terms of your purchase agreement and whether they disclosed what they were required to, and whether they knew about the project, etc.

A key element to any case is "damages," and thus you'd have to be able to prove and demonstrate how you were damaged and the amount. If the sewer actually improves the value of the home, then this might offset any costs you have incurred or will incur.

However, most of the time connecting to city sewer actually improves the value of your home, despite the costs that could be incurred up front (versus using a septic system).
